Terms of Service

1. The Service

ForkPeace is a family dinner planning web application. It lets families maintain a shared dinner library, vote on what to eat, and track dinner history. Optional AI-powered features (recipe suggestions, pantry scanning) depend on third-party APIs and may require a paid subscription. Features may change over time as described in Section 8.

2. Eligibility

You must be at least 13 years old to create an account. If you are under 18, a parent or guardian must agree to these terms on your behalf. By creating an account, you confirm you meet these requirements.

3. Your Account

• You are responsible for keeping your password secure and for all activity under your account.
• Each family has one Head of Household (HoH) who manages the family, members, and subscription. The first person to create a family is automatically the HoH.
• The HoH may invite additional family members. Invited members agree to these terms when they accept their invitation.
• Each family account may have up to 10 members total.
• Do not share your account credentials with people outside your household.
• Notify us immediately at jeff@dwoskinfamily.com if you discover any unauthorized use of your account.

4. Subscriptions & Billing

ForkPeace offers a free tier (limited recipe library) and two paid plans:

• BYOK (Bring Your Own Key) — You provide your own Anthropic API key for AI features. Billed monthly.
• Managed AI — AI features are included with monthly usage limits. Billed monthly.

Payments are processed by Stripe. We do not store your card details. Subscriptions renew automatically until cancelled. You may cancel at any time via the billing portal in Family Settings; your plan remains active until the end of the current billing period. Refunds are not provided for partial billing periods, except where required by law. We may change pricing with reasonable notice by email.

BYOK Plan — Your Responsibilities

If you use the BYOK plan, you are solely responsible for: (a) securing your Anthropic API key and preventing unauthorized use; (b) all API charges Anthropic bills to your key, including charges from use outside ForkPeace if your key is compromised; and (c) compliance with Anthropic's own terms. We are not a party to your agreement with Anthropic and accept no liability for charges to your key.

Payment Failure & Downgrade

• If a payment fails, Stripe will retry automatically per its standard retry schedule. If payment is not resolved within that window, your account reverts to the free tier and AI features are disabled until payment is resolved.
• Downgrading from a paid plan to free takes effect at the end of your current billing period. You will not lose your existing data — only AI features and limits beyond the free tier will be restricted.
• If your subscription lapses and you re-subscribe, your data will still be there.
• Canceling your subscription does not delete your family's data. Your entire dinner library, vote history, and member information remain intact. Canceling only removes access to paid AI features — no recipes, logs, or settings are deleted.

5. Your Content

You are responsible for all content you add to ForkPeace — recipes, notes, photos, family names, and other data ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, display, and process Your Content solely to operate the Service for you. We do not claim ownership of any content you add.

• You are responsible for ensuring Your Content does not infringe third-party rights. Many recipes are collected from external sources and remain subject to those sources' own terms — we are not responsible for that content.
• Do not add content that is unlawful, harmful, offensive, or that you do not have the right to use.
• We reserve the right to remove content that violates these terms or applicable law.

DMCA — Copyright Infringement

We respect intellectual property rights. If you believe content accessible through the Service infringes your copyright, send a written notice to jeff@dwoskinfamily.com that includes: (i) identification of the copyrighted work; (ii) identification of the infringing material and its location; (iii) your contact information; (iv) a statement of good faith belief that use is unauthorized; and (v) a statement under penalty of perjury that the information is accurate and you are authorized to act. We will respond to valid notices promptly.

5a. Recipes & Dietary Information

Not Professional Advice. Recipes on ForkPeace are added by individual family members, not by certified food professionals, dietitians, or allergists. Any dietary or allergen information — such as "contains nuts," "gluten-free," or similar flags — reflects only what the person who entered the recipe believed to be true at the time of entry. ForkPeace does not verify, certify, or guarantee the accuracy of any recipe's ingredients, preparation instructions, or dietary and allergen information.

You are solely responsible for reviewing any recipe — including its full ingredient list and any dietary or allergen flags — before preparing it for yourself or others. If you or anyone in your household has a known food allergy, intolerance, or dietary restriction, independently verify all ingredients before use.

ForkPeace makes no representation that any recipe will produce the expected result. Cooking outcomes — including taste, texture, doneness, and overall food quality — depend on factors outside our control, including ingredient variations, equipment, technique, and individual interpretation of instructions.

By cooking or serving any recipe found in ForkPeace, you agree not to hold ForkPeace, JLD Concepts LLC, or the family member who entered the recipe liable for any outcome, including any outcome resulting from incomplete, inaccurate, or missing dietary or allergen information, or from a recipe not turning out as expected.

Imported Recipes

Recipes imported via the URL import feature are processed by automated technology that reads and extracts data from third-party websites. This process may result in incomplete, inaccurate, or missing information — including wrong ingredient quantities, omitted steps, incorrect cooking times, or other errors introduced during parsing. ForkPeace does not verify the accuracy of any imported recipe. You are responsible for reviewing all imported recipes carefully before preparing them, and you agree not to hold ForkPeace or JLD Concepts LLC liable for any outcome resulting from errors in an imported recipe.

6. AI Features

AI features (dinner suggestions, pantry scanning) use the Anthropic Claude API. When you use these features:

• Recipe names, ingredient lists, and similar content may be sent to Anthropic to generate results. Pantry photos are sent to Anthropic for ingredient recognition.
• We do not send personally identifying information (names, emails) to Anthropic as part of AI prompts.
• Anthropic's handling of that data is governed solely by Anthropic's Terms and Privacy Policy. We make no representations about their data practices.
• AI outputs are suggestions only. You are responsible for reviewing all AI-generated suggestions before acting on them, particularly those relating to dietary needs, allergies, or health. We make no guarantees about accuracy, completeness, or suitability for any individual.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any law.
• Attempt to access other families' data or circumvent access controls.
• Abuse AI features — including automated requests, scripted or bulk API calls, or any attempt to circumvent usage limits on Managed AI plans.
• Use an Anthropic API key provided by or through ForkPeace (including BYOK keys stored in the Service) for any purpose outside of ForkPeace, share it with third parties, or use the Service as a proxy to access third-party AI services for unrelated work.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to send spam or unsolicited communications.
• Use automated scripts, bots, or crawlers to interact with the Service.
• Interfere with or disrupt the integrity or performance of the Service.

8. Service Availability

ForkPeace is provided on an "as available" basis. We do not guarantee:

• Uninterrupted or error-free access at any particular time.
• That AI features — which depend on third-party APIs — will always be available or perform consistently.
• That any specific feature will remain available in its current form indefinitely.

We may modify, suspend, or discontinue any feature with reasonable notice. If we discontinue a feature material to your current paid plan, we will provide a pro-rated refund for the affected period. Third-party service outages (Anthropic, Stripe, Resend, Supabase, etc.) are outside our control and do not constitute a breach of these terms.

The Service is hosted on Vercel. Availability is also subject to Vercel's Terms of Service and infrastructure availability.

9. Termination

You may request account deletion at any time by contacting us at jeff@dwoskinfamily.com. We may suspend or terminate your account for operational, security, legal, or abuse-related reasons, with reasonable notice where practicable.

Immediate Termination for API or AI Misuse

Misuse of any API access or AI credits provided by or through ForkPeace constitutes a material breach of these terms. This includes, without limitation: using a ForkPeace-managed or BYOK Anthropic API key for purposes outside the Service; sharing API credentials with third parties; circumventing Managed AI usage limits; making automated or bulk requests to AI endpoints; or using ForkPeace as a proxy to access third-party AI services for work unrelated to family dinner planning. Upon discovery of such misuse, we reserve the right to suspend or terminate your account immediately, without prior notice, and without refund of any subscription fees paid — including fees for the current billing period.

Upon termination:

• We will delete your account and associated data within 30 days.
• Encrypted backup copies held by our infrastructure providers may persist beyond that before being permanently purged, subject to those providers' own retention policies.
• Billing records may be retained longer where required by applicable law.
• Active subscription charges cease as of the termination date; partial-period refunds are at our discretion.

Note for Heads of Household: If a HoH requests account deletion, other family members retain access to the shared dinner library and vote history. Recipes added by the departing HoH remain in the family's library, attributed to "a former family member." The family subscription may be affected — contact us to arrange a plan transfer if needed.

10. Indemnification

You agree to defend, indemnify, and hold harmless JLD Concepts, LLC, its officers, employees, agents, and assigns from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these terms; or (d) your violation of any third-party rights.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Dietary information and AI-generated suggestions are for informational purposes only and are not professional nutritional or medical advice. We are not responsible for decisions made based on AI suggestions.

12. Limitation of Liability

To the maximum extent permitted by law, JLD Concepts, LLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of revenue, or personal injury — arising from your use of the Service. Our total liability for any claim arising out of these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. Users on the free tier acknowledge the Service is provided at no charge and that our liability for free-tier use is limited accordingly.

13. Dispute Resolution

Informal Resolution First

Before filing any formal dispute, you agree to contact us at jeff@dwoskinfamily.com and give us 30 days to attempt resolution informally.

Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these terms or the Service will be resolved by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. The arbitration will take place in Oakland County, Michigan or remotely, at your election.

Class Action Waiver

You and JLD Concepts, LLC each waive the right to participate in class action litigation or class-wide arbitration. All disputes must be brought in an individual capacity only.

Small Claims Exception

Either party may bring a qualifying claim in small claims court instead of arbitration, provided the claim remains an individual (non-class) claim within that court's jurisdictional limits.

Jury Trial Waiver

To the extent any dispute proceeds in court rather than arbitration, each party knowingly and voluntarily waives any right to a trial by jury.

Opt-Out

You may opt out of binding arbitration within 30 days of first accepting these terms by emailing jeff@dwoskinfamily.com from your account email address, with "Arbitration Opt-Out" in the subject line and your full name and account email in the body. Opt-outs without this information will not be valid.

14. Governing Law

These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts in or nearest to Oakland County, Michigan for any dispute not subject to arbitration under Section 13.

15. General Provisions

• Entire Agreement. These terms constitute the entire agreement between you and JLD Concepts, LLC regarding the Service and supersede all prior agreements.
• Severability. If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
• No Waiver. Our failure to enforce any right or provision of these terms is not a waiver of that right.
• No Assignment. You may not assign these terms or any rights hereunder without our express written consent. We may assign our rights freely.
• Statute of Limitations. Any claim or cause of action arising out of or related to the Service must be filed within one year after the claim arose, or it is permanently barred.
• Attorneys' Fees. If we must take action to enforce these terms, you agree to reimburse our reasonable attorneys' fees and costs.
• No Joint Venture. Nothing in these terms creates a joint venture, partnership, employment, or agency relationship between you and JLD Concepts, LLC.

16. Changes to These Terms

We may update these terms at any time. The "last updated" date at the top of this page reflects when they were most recently changed. For material changes, we will make reasonable efforts to notify registered users. Your continued use of the Service after any update constitutes acceptance of the revised terms. The current version is always available at forkpeace.com/terms.
